Interpretation And Variation

“Terms and Conditions” means the terms and conditions detailed below. Brighton Bike Sheds reserves the right to vary and revoke the Terms and Conditions when it considers this necessary. The Terms and Conditions are governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

Purchasing

All orders for goods shall be deemed to be an offer by the buyer to purchase goods pursuant to these Terms and Conditions and are subject to acceptance by Brighton Bike Sheds. Brighton Bike Sheds may choose not to accept an order for any reason. Purchasing can be made through Brighton Bike Sheds secure online payment system.

Pricing

All prices and charges on this site are shown in UK pounds sterling and include any VAT payable. The total cost of your order will be the price of the products that you order and the cost of any additional services or products you choose. All costs will be set out clearly in your shopping trolley before you submit your order. Brighton Bike Sheds always endeavours to ensure that all information on this website is accurate. However, if an error does occur in the price or description, Brighton Bike Sheds will inform you and ask you whether you still wish to continue with the order. Brighton Bike Sheds reserve the right to change the price of a product at any time. If you require any products in bulk please contact Brighton Bike Sheds for potential discounts.

Payment

Brighton Bike Sheds accepts card payments via Mastercard, Visa, and PayPal. Payment is deducted when the order is processed. Payment can be made on the website using the secure online payment system. When an order is made through the secure online payment system, after payment is received, Brighton Bike Sheds shall confirm by email the details, description and price of the goods purchased together with information containing your rights to cancel the order. Payment of all charges for products on order must be made in full before dispatch of the goods. Brighton Bike Sheds reserve the right to refuse orders if deemed necessary.

Preparation pre-installation.

Brighton Bike Sheds external dimensions are clearly described on the website and it is the responsibility of the purchaser to read the sizing guidelines prior to purchasing to avoid ordering a product that is too large for a given space. If the Brighton Bike Sheds installation team arrive at the delivery address and are unable to install the product due to it being too large for the given space then the purchaser will have two options: 1. suggest a suitable alternative site, or 2. accept the product un-installed. Our sheds rely on a level base to fit together successfully. If the base has been correctly set level, the shed will fit together without any problems. Therefore we are not liable for non-aligning doors or non-level/plumb walls or bases etc if the base has not been correctly installed.

Delivery And Installation

Brighton Bike Sheds make every effort to deliver goods within the published estimated timescales; however, delays are occasionally inevitable due to unforeseen factors beyond our control and therefore delivery times are not guaranteed. Estimated delivery dates are not part of the contract between Brighton Bike Sheds and the buyer, and Brighton Bike Sheds shall be under no liability for any delay or failure to deliver the products within the estimated timescale. Unless otherwise agreed in writing by the purchaser and Brighton Bike Sheds, the delivery and installation of goods will take place at the address you have specified in the order. When the delivery arrives at the specified address someone must be present to accept it and if installation has been selected, allow the installation team access to the installation site and access to a power supply if required during the installation, which typically lasts 2/3 hours. If a delivery is made and nobody is there to allow the installation team access to the installation site then the product will be returned to base to await another suitable dispatch date. In these circumstances the purchaser will be held responsible for paying all additional delivery costs to have the item re transported. When ordering a bike shed for self assembly you undertake to select the appropriate delivery zone as set out in our delivery pages.

Our installation cancellation policy applies to all cancellations, postponements and late rearrangements of scheduled installations. The fees are as follows. Less than 24hr: £295 fee. From 24hr to 72hr: £150 fee. All cancellations, postponements and late rearrangements of scheduled installations or deliveries must be by email.

Delivery Only/ Self Assembly

We send bike sheds out on pallets with our couriers, who work on a 2-3 day delivery schedule. We aim to ensure your bike shed arrives complete and on time. However, if there are any issues with damaged or missing items please contact Brighton Bike Sheds within 48 hours with details so we can resolve the issue promptly. We provide full instructions on fitting your bike shed which are designed to be easy to follow. Our sheds rely on a level base to fit together successfully. If the base has been correctly set level, the shed will fit together without any problems. Therefore we are not liable for non-aligning doors etc if the base has not been correctly installed. If the proposed location is on a slope and problems arise with achieving a level base we would advise on adding timber bearers to the underside of the base. Please be aware that we do not provide any additional bearers and these would need to be selected as appropriate from a suitable timber supplier. Lastly, if you have ordered a green roof shed, we recommend that you unroll and water the sedum blankets upon arrival. This advice will all be included in your fitting instructions.

All images and photography used on the Brighton Bike Sheds website is purely for illustrative purposes only – actual product colours may vary slightly due to the digital photography process and variations in individual user monitor settings. This will not detract from the overall quality or performance of the product.

Events Outside Our Control

Brighton Bike Sheds cannot be liable or responsible for any failure to perform, or delay in performance of any of our contracted obligations that is caused by events outside of our reasonable control (Force Majeure Event). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
Strikes, lockouts and other industrial actions, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, impossibility of the use of public or private telecommunications networks, any new acts, decrees, legislation, regulations or restrictions of any government.
We reserve the right to delay the completion of any of our obligations if we are hindered or prevented from doing so due to a Force Majeure Event, provided that, if the circumstances in question continue for a continuous period in excess of 120 days, either party shall be entitled to give notice in writing to the other to terminate the Agreement.

Bespoke/custom Products

Goods that are ordered to your specification, for example made to order bike sheds, cannot be cancelled or returned once the order is accepted. In this case, after we have sent you our confirmation email you will have entered into a binding contract to buy the goods, and because the goods are being made to your specification you will not be able to cancel that contract. Once the goods have been delivered you can only return them if they are not reasonably fit for the purpose and we cannot remedy the fault to your reasonable satisfaction. Orders of bespoke products may also extend the average delivery lead time.

Timber And Other Natural Products

Timber is a natural product and prone to changes in appearance, including some movement and the occurrence of small knot holes or splits in extreme temperatures and weather conditions. Any splits, knots or similar visual imperfections in the timber will not affect the structural integrity of the product in any way. Whilst every effort is made to hand pick timber without visible knotholes or splits there may be occasions where timber is selected in good faith that contains what appears to be a solid knot. Over the course of time / during movement of the product etc it may occur that these small knot holes are then dislodged from the timber leaving a small knot or crack. Unfortunately we cannot be held responsible for this maturing of the product and can only offer our best advice as how to deal with this situation in the unlikely event that it should occur. Please note any guarantee offered does not cover the products against timber splits or warping, as this is something that can occur naturally over time. These are natural characteristics of the products and not defects and will not be accepted as a valid reason for the cancellation of an order.

Vandalism/break ins

We offer a good level of security as standard specification. We offer an internal locking point which allows bikes to be locked with chains on the inside. Hinges are fitted with clutch head screws and a solid long-throw lock is used. We can also, on request, add a second lock and ply panels to the inside of the doors to further increase security to doors in areas that are prone to break-ins. In any case we cannot be liable for the theft of bikes or property from any of our bike sheds. By installing a bike shed you are accepting that there are some risks associated with the storing of items in an external outbuilding. If you do have a break-in or vandalism to your shed you can contact us regarding repairs which we can make arrangements to do for you at an hourly rate, plus materials.
